Under new legislation to be implemented in England from 1st July 2007, almost all enclosed public places and workplaces in England will become smoke-free. Although still in draft form, the regulations will also cover vehicles as well as buildings, including LGVs, vans and company cars.
As an employer you must: • display 'no smoking' signs in smoke-free premises (including vehicles); • take reasonable steps to ensure that staff, customers, and visitors are aware that premises and vehicles are legally required to be smoke-free; • ensure that no one smokes in smoke-free premises or vehicles.
Failure to comply with this legislation will lead to fixed penalty notices and/or fines: • Smoking in a smoke-free place - £50 FPN or up to £200 fine • Failure to display the necessary signage - £200 FPN or up to £1000 fine • Failing to prevent smoking in a smoke-free place - up to £2500 fine
A freephone number will be created to enable employees and members of the public to report breaches of the legislation.
Where a vehicle is used as a workplace by more than one person, even if they are not in the vehicle at the same time (and even if all users are smokers), it must be smoke-free at all times. However, smoke-free legislation will not apply to vehicles that are used primarily for private rather than work purposes.
